How to Overnight Legal and Tax Documents
Which overnight services count for IRS and court deadlines, why the carrier's dated record matters, and how to pick a service that beats the clerk's clock.
To overnight a legal or tax document, pick a named service whose published delivery time beats your deadline, keep the carrier's dated record, and check which date your deadline actually runs on. For federal tax filings, only the private delivery services the IRS designates count for its timely-mailing rule, and FedEx Express Saver, UPS 3 Day Select and both carriers' Ground services are not on that list. This is shipping guidance, not legal advice, so confirm the rule with the court, the agency or your attorney.
Which overnight services count for IRS deadlines?
The exact service on the label decides it, because the IRS says its designated private delivery services "include only" the ones it lists. The table compares common domestic services with the IRS private delivery services page as read in November 2026.
| Service | On the IRS list? | Carrier's published delivery |
|---|---|---|
| UPS Next Day Air | Yes | Next business day by 10:30 a.m. to most commercial addresses |
| UPS Next Day Air Saver | Yes | End of the next business day |
| UPS 2nd Day Air | Yes | End of the second business day |
| UPS 3 Day Select | No | End of the third business day |
| UPS Ground | No | Depends on the lane |
| FedEx First Overnight | Yes | Next business day, 8 to 9:30 a.m. in most areas |
| FedEx Priority Overnight | Yes | Next business day by 10:30 or 11 a.m. |
| FedEx Standard Overnight | Yes | Next business day by 5 p.m. |
| FedEx 2Day | Yes | Second business day by 5 p.m. |
| FedEx Express Saver | No | Third business day |
| FedEx Ground | No | Depends on the lane |
The IRS list also names UPS Next Day Air Early A.M., UPS 2nd Day Air A.M. and several international and DHL Express services. The wrong line can end a case. In Lynch v. Commissioner, as reported by Business Law Today in May 2024, a Tax Court petition due January 22, 2024 went out that day by FedEx Express Saver, arrived January 24, and the court held it could not hear the case.
Does a USPS postmark still prove the mailing date?
A postmark alone is weaker proof than it looks, because USPS says the postmark date does not necessarily show the first day it had the mailpiece. That is the wording of its postmark rule, published November 24, 2025. A postmark applied at a processing facility can be later than the day you handed the envelope over.
If USPS is your route for a deadline filing, take it to a Post Office counter. USPS says you can request a manual postmark there for no extra fee, and that a Certificate of Mailing gives you a record of the date it accepted the piece. Certified and Registered Mail also provide mailing receipts, so ask your tax adviser which one your filing needs. USPS Priority Mail Express is not a private delivery service, and its published window is 1 to 3 days by 6 p.m., with next-day delivery only between eligible ZIP pairs. Do not treat it as overnight without checking your lane.
Where do you send a private carrier filing to the IRS?
Send it to the IRS street address for private delivery, not the PO Box in the form instructions. The IRS says private delivery services should deliver to its submission processing center street addresses only, and it picks the center by return type. The IRS also says the carrier can tell you how to get written proof of the mailing date, so ask before the deadline day and keep that record in the file.
Does overnight delivery change a court deadline?
It can, but the rule belongs to the court, so read the one that governs your case. In California, for example, Code of Civil Procedure section 1013(c) says service by overnight delivery is complete at deposit and extends the response period by two court days, with exceptions that include a notice of appeal and a notice of intention to move for a new trial. It also spells out the handoff: a box or facility the carrier maintains, or an authorized courier or driver, in an envelope or package the carrier designates.
Other courts write this differently. Service on another party and filing with a clerk can also follow different clocks, and a filing often turns on when it is received. Call the clerk if the rule is not clear.
Which service fits which document?
Start from the clock on the other end, because "next day" covers everything from early morning to the end of the day. Year-end moves that clock: the UPS year-end schedule extends packages scheduled for delivery from November 27, 2026 to January 2, 2027, with Next Day Air going to 3 p.m. at commercial locations and end of day at homes. FedEx extended its morning commitments by 90 minutes last peak season, so check its notices too. The table is a starting point for your own lanes.
| Job | Price these first | Watch for |
|---|---|---|
| Filing due at a clerk's window | UPS Next Day Air, FedEx Priority Overnight | Saver and Standard Overnight can land after the window closes; at year-end, so can Next Day Air |
| Signed loan package to a lender | UPS Next Day Air, FedEx Priority Overnight | Weight: most packages are not letters |
| Deed to a county recorder | UPS Next Day Air Saver, FedEx Standard Overnight | Recorder's hours and any cover sheet rules |
| Federal return with days to spare | UPS 2nd Day Air, FedEx 2Day | The service must be on the IRS list |
| Originals to a client at home | UPS Next Day Air | UPS's commitment moves to noon at homes, and to end of day at year-end |
Weight is the other surprise. Example: a 150-page loan package on 20 lb bond is about 150 x 4.5 g, or 675 g. That is roughly 1.5 lb, so it bills as a 2 lb package and not at a letter rate. UPS's 2026 guide lists the Letter tier at up to 8 oz, which is roughly 40 sheets by our estimate, though an older UPS sheet states no cap. Our page on the UPS overnight envelope covers that conflict and what else disqualifies the rate. FedEx's 2026 Service Guide heads its envelope rate "FedEx Envelope up to 8 oz," and our FedEx overnight guide covers how its tiers bill.
What should the deadline checklist include?
Run the same short list every time, because deadline mistakes are usually handoff mistakes and not carrier mistakes.
- Confirm which date counts: mailing, service or receipt.
- Read the exact service name on the label before you pay.
- Check the address: IRS street address, or the suite and department the court or lender gave you.
- Hand it over before that location's cut-off for that service. A drop box may already have had its last pickup.
- Keep the carrier's dated receipt and tracking number in the file.
- Add a signature if you need a record of who received it.
- Check tracking the next morning, while there is still time to send a duplicate.
The comparison of UPS Ground, 2nd Day Air and Next Day Air helps if you are deciding whether a job needs air at all.
Where GoatLabels fits
GoatLabels quotes UPS Next Day Air, Next Day Air Saver and 2nd Day Air, FedEx First, Priority and Standard Overnight and 2Day, and USPS Priority Mail Express beside each other when the lane and parcel offer them, each as one all-in price. USPS, UPS and FedEx are rate-shopped on every domestic parcel, and DHL joins on international lanes. A reference such as a matter number stays on the shipment and its ledger line, which helps when a firm bills shipping back to a client. Signature confirmation and adult signature are available on UPS services other than UPS Ground Saver.
GoatLabels prints the label. It does not decide what counts as timely filing, and it does not issue proof of mailing: the dated record is the carrier's. Support is email and the in-app assistant, with no phone line, which matters on a same-day deadline. Free: 50 shipments a month. Pro: a flat $40 a month, unlimited shipments. Label prices are the same on the Free and Pro plans. See pricing.
